What you're agreeing to.
The 60-second version: Use Ezra reasonably and legally. He's software — sometimes wrong, sometimes down. You own your data. Currently free; 14 days notice before any paid tier. Cancel anytime by texting "delete me." Email first if you have a complaint.
1. About these terms
By using Ezra, you accept these Terms. They work together with our Privacy Policy.
2. Eligibility
- You must be at least 18 years old.
- Have a valid Apple ID (for iPhone) or Android device with RCS.
- Live in a jurisdiction we currently serve.
- Not be on a sanctions list.
- Not have been previously banned.
3. Your account
Your account is identified by your phone number. You're responsible for actions taken via your account. One human, one account. Sharing accounts isn't allowed.
4. The service
Ezra is an AI agent in your iMessage. He receives messages, processes them via Claude (Anthropic's API), takes actions on connected services with your permission, and replies in iMessage. The service is software — it may be temporarily unavailable, evolve over time, and isn't perfect.
5. Subscription, billing, cancellation
Free service (currently): Ezra is free for everyone right now. We may impose usage limits to manage costs.
Future paid tiers: If we introduce paid tiers, you'll get an iMessage with at least 14 days' notice. You can upgrade, decline (and lose paid features), or delete your account before billing begins. No charges without your explicit opt-in.
Once paid tiers exist: Subscriptions are billed in advance. Stripe handles payments. Auto-renew unless canceled. Cancel any time by texting "cancel subscription" or via the billing page.
Refunds (when paid tiers exist): 30-day refund window on initial subscriptions, no questions asked.
Failed payments: We retry twice over 7 days, then suspend (not delete). After 30 days of suspension, the account is permanently deleted unless reactivated.
6. Acceptable use
You agree not to use Ezra for:
- Illegal activity, harassment, threats, hate speech, content harmful to children, or content violating others' rights
- Spam, phishing, scams, impersonation
- Attempting to extract or jailbreak Ezra's prompts/guardrails
- Automated bulk message sending in violation of Apple's iMessage terms or carrier RCS terms
- Developing a competing product
- Activity that violates third-party rights or the terms of services you connect
- Activity prohibited by Anthropic's Acceptable Use Policy
Violations may result in suspension, termination, and (for serious cases) reporting to authorities.
7. Your data and content
You own your data. Period. To operate the service, you grant us a limited license to receive, store, and process your messages and connected-service data; send relevant data to Anthropic for AI inference; and use anonymized aggregated metadata to improve the service. This license lasts only as long as your account and is solely for operating Ezra for you.
8. AI output disclaimers
- AI can be wrong. Outputs may contain errors or hallucinations.
- AI can be unpredictable. Same input may produce different outputs.
- Verify important outputs. Don't rely on Ezra for medical, legal, financial, or safety-critical decisions without independent professional verification.
- AI output is not professional advice.
- You're responsible for actions you authorize. If you tell Ezra to send something and he sends it, that's you sending it.
9. Third-party services
Ezra uses Apple's iMessage, Twilio's RCS, BlueBubbles relay, Anthropic's Claude API, Stripe, and various connected services (Gmail, Notion, Slack, etc.). Their terms apply to their parts of the service. We don't control their availability.
10. Intellectual property
Ours: Ezra's software, design, branding, character, and persona. You may not copy, modify, distribute, or reverse-engineer.
Yours: Your data, your content, and outputs the agent generates from your specific inputs.
Feedback: If you send us feedback, we may use it to improve the service without compensation. We won't credit you publicly without permission.
11. Service availability
We aim for high availability but don't guarantee uptime. The service may be unavailable for maintenance, third-party issues, security incidents, or force majeure events.
12. Termination
By you: "Delete me" → full account deletion within 24 hours. Cancel subscription if applicable. Email us for any other reason.
By us: We may suspend or terminate for violations, fraud, abuse, or legal compliance. We'll usually notify before terminating, except where doing so would compromise security or violate law.
13. Disclaimer of warranties
The service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI outputs.
14. Limitation of liability
To the maximum extent permitted by law: we shall not be liable for indirect, incidental, consequential, special, or punitive damages. Our total liability for any claim is limited to the greater of (a) amounts you've paid us in the 12 months before the claim, or (b) $100 USD.
15. Indemnification
You agree to indemnify us from any claims arising from your violation of these Terms, your misuse of the service, your violation of third-party rights, or content you submit that infringes others' rights.
16. Dispute resolution
Email first: Please email us about any complaint before pursuing legal action.
Governing law: Delaware, without regard to conflict-of-laws principles.
Arbitration: Disputes that can't be resolved by email will be resolved by binding individual arbitration. Class actions waived. Either party may bring eligible claims in small-claims court instead. You may opt out of arbitration within 30 days of accepting these Terms by emailing us.
Time limit: Claims must be brought within one year of the event giving rise to them.
17. Changes to these terms
Material changes: 7 days' iMessage notice before they take effect. Continued use after changes means you accept the updated Terms. If you don't accept, text "delete me" or email us before the effective date.
18. Miscellaneous
- Entire agreement: These Terms + Privacy Policy.
- Severability: If any part is unenforceable, the rest remains in effect.
- No waiver: Failure to enforce any provision doesn't waive future enforcement.
- Assignment: You can't transfer these Terms; we can in a successor entity scenario (we'll notify per Privacy Policy).
- Force majeure: Neither party is liable for failure to perform due to events beyond reasonable control.
